With the following information, we would like to provide you with an overview of the processing of your personal data by us and your rights under data protection law. Which specific data are processed and how they are used depends substantially on the services requested or agreed in each case. Therefore, not all sections of this information will apply to you. We process your data for the following purposes and on the following legal bases:
We process personal data in accordance with the provisions of the GDPR and the Federal Data Protection Act (BDSG)
To fulfil contractual obligations (Art. 6(1)(b) GDPR):
Processing is necessary for the performance of a contract with you. Where applicable, this also includes sending the newsletter, which constitutes a contractual service. If you enquire with us regarding an offer, the data processing is carried out upon your request and is necessary for taking steps prior to entering into a contract.
Pursuant to statutory requirements (Art. 6(1)(c) GDPR):
We are subject to various legal obligations that entail data processing. These include, for example, tax laws as well as statutory accounting, responding to enquiries and requirements from supervisory or law enforcement authorities, and fulfilling control and reporting obligations under tax law. Furthermore, the disclosure of personal data may become necessary within the scope of official/judicial measures for the purposes of gathering evidence, law enforcement, or asserting civil law claims.
Within the scope of a balancing of interests (Art. 6(1)(f) GDPR):
Where necessary, we process your data beyond the actual performance of the contract in order to safeguard our legitimate interests or those of third parties. Examples of such cases include:
- If you contact us by email or telephone, the data you enter will be stored for the purpose of individual communication with you,
- Asserting legal claims and defence in legal disputes,
- Storing additional contact persons in the CRM system for communication purposes.
Who receives your data?
Within our company, employees receive your data for contact with you and contractual cooperation (including the taking of steps prior to entering into a contract). Your data will only be forwarded to service providers (processors) if this is necessary for the performance of our contractual duties (e.g. support/maintenance of EDP/IT applications, accounting, document shredding/data destruction). All service providers are obliged to treat your data confidentially on the basis of a data processing agreement.
With regard to the transfer of data to recipients outside our company, it must first be noted that we only transfer necessary personal data in compliance with the applicable data protection regulations. Subject to these prerequisites, recipients of personal data may include, for example:
- public authorities and institutions (e.g. tax authorities, law enforcement authorities) where a statutory or regulatory obligation exists,
- credit and financial services institutions (processing of payment transactions)
- tax advisors, auditors, and tax/company wage tax auditors (statutory audit mandate)
Are data transferred to a third country or to an international organisation?
Your data are processed exclusively within the European Union and countries within the European Economic Area (EEA).
How long will your data be stored?
We process and store your personal data for as long as this is necessary to fulfil our contractual and legal obligations. Once the data are no longer required to fulfil contractual or legal obligations, they are erased on a regular basis. Exceptions to the above-mentioned erasure criteria arise for data,
- which are necessary for fulfilling statutory retention obligations, e.g. the German Commercial Code (HGB) and the German Fiscal Code (AO). The retention and documentation periods specified therein are generally six to ten years,
- for preserving evidence within the scope of statutory limitation provisions. Under Sections 195 et seq. of the German Civil Code (BGB), these limitation periods can be up to 30 years, with the standard limitation period being three years.
Where data processing is carried out based on our legitimate interest or that of a third party, the personal data will be erased as soon as this interest no longer exists. The aforementioned exceptions apply here.
What data protection rights do you have?
Every data subject has the right of access under Art. 15 GDPR, the right to rectification under Art. 16 GDPR, the right to erasure under Art. 17 GDPR, the right to restriction of processing under Art. 18 GDPR, the right to object under Art. 21 GDPR, and the right to data portability under Art. 20 GDPR.
With regard to the right of access and the right to erasure, the restrictions under Sections 34 and 35 BDSG apply. In addition, there is a right to lodge a complaint with a competent data protection supervisory authority (Art. 77 GDPR). A list of supervisory authorities (for the non-public sector) with addresses can be found at: https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html
Is there an obligation for me to provide data?
Within the scope of the contractual relationship, you may provide the personal data that are necessary for the initiation, performance, and termination of the contractual relationship and for fulfilling the contractual obligations associated therewith, or which we are legally obligated to collect. Without these data, we will not be in a position to contact you, conclude the contract with you, or perform it.
Information about your right to object pursuant to Art. 21(1) sentence 1 GDPR
Right to object on a case-by-case basis
You have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data by us, where this is based on Art. 6(1)(f) GDPR (data processing based on a balancing of interests). If you lodge an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
Recipient of an objection
The objection can be made informally with the subject line “Objection”, stating your name, your address and your date of birth, and should be addressed to:
