3. Cookies

In order to make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your device. This data is stored and used exclusively for the purpose of responding to your request or for contacting you and the associated technical administration. The legal basis for processing the data is the initiation of a business relationship or the performance of a contractual relationship pursuant to Art. 6(1)(b) GDPR. Your data will be erased after your inquiry has been conclusively processed; this is the case when it can be inferred from the circumstances that the matter in question has been definitively clarified and provided that there are no statutory retention obligations to the contrary. If you wish to contact us, providing this data is mandatory.

5. Data processing upon entering into a (pre-)contractual relationship and opening a customer account

Pursuant to Art. 6(1)(b) GDPR, personal data continues to be collected and processed if you provide it to us for the performance of a contract. Which data is collected can be seen from the respective input forms. Data collection is limited to: Name (voluntary), email address, telephone number (voluntary). Erasure of your customer account is possible at any time and can be effected by sending a message to the above-mentioned address of the controller. We store and use the data provided by you for contract execution. Following complete performance of the contract or erasure of your customer account, your data will be blocked with regard to tax and commercial law retention periods and erased after expiry of these periods, unless you have expressly consented to further use of your data or we have reserved the right to further use of data as permitted by law, about which we inform you accordingly below. In this regard, the three companies are each independently responsible for the lawful processing of personal data and the granting of data subject rights, including the provision of mandatory information. Where necessary, the companies support each other in this regard.

We carry out this data flow within the framework of our legitimate interest in the division of functions pursuant to Art. 6(1)(f) GDPR.

6. Use of your data for direct marketing

6.1 Subscribing to our email newsletter

If you subscribe to our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. The provision of any other data is voluntary and is used to address you personally. For sending the newsletter, we use the so-called double opt-in procedure. This means that we will only send you an email newsletter once you have expressly confirmed to us that you consent to receiving the newsletter. We will then send you a confirmation email asking you to confirm that you wish to receive newsletters in the future by clicking on a corresponding link.

By activating the confirmation link, you grant us your consent to the use of your personal data pursuant to Art. 6(1)(a) GDPR. When you register for the newsletter, we store your email and the time of confirmation. The data collected by us when subscribing to the newsletter is used exclusively for promotional purposes by way of the newsletter. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter, edit the settings directly via our newsletter page, or by sending a corresponding message to the controller named at the beginning. Once you have unsubscribed, your email address will be erased from our newsletter mailing list without undue delay, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this policy.

The provision of your data is not mandatory or required by contract or by law for the purposes of the newsletter. Without providing it, however, we cannot send you any information.

Mailchimp is used as newsletter software. Your data is thereby transmitted to Mailchimp. Mailchimp is prohibited from selling your data and from using it for purposes other than sending newsletters.

Data is only processed in this context for as long as the corresponding consent or corresponding objection exists. Thereafter, it is erased.

The provision of your personal data is voluntary, solely on the basis of your consent and where our legitimate interest exists. Without existing consent or without an existing legitimate interest, we unfortunately cannot deliver our newsletter to you. Should you wish to withdraw your consent, this is possible using the unsubscribe link in the respective newsletter. Alternatively, you can also send an email to [email protected].

– Right to object pursuant to Art. 21 GDPR: The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions.

Data protection measures are constantly subject to technical updates; for this reason, we ask you to inform yourself about our data protection measures at regular intervals by consulting our privacy policy.

6.2 Sending the email newsletter to existing customers

If you have provided us with your email address when initiating or purchasing a service, we reserve the right to regularly send you offers for similar services from our portfolio by email. For this purpose, we do not need to obtain separate consent from you pursuant to Section 7(3) of the Act against Unfair Competition (UWG). In this respect, data processing takes place solely on the basis of our legitimate interest in personalised direct marketing pursuant to Art. 6(1)(f) GDPR. If you initially objected to the use of your email address for this purpose, we will not send any emails. You are entitled to object to the use of your email address for the aforementioned advertising purpose at any time with effect for the future by notifying the controller named at the beginning. In this case, you will only incur transmission costs according to the basic rates. Following receipt of your objection, the use of your email address for advertising purposes will be stopped immediately. The storage period is determined by our contractual relationship. As soon as this ends and there are no statutory retention obligations to the contrary, your data will be removed.

7. Use of social media

7.1 Use of YouTube videos

This website uses the YouTube embedding function to display and play videos from the provider “YouTube”, which belongs to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Accordingly, when you access a page containing the YouTube plugin, your personal data is forwarded to Google LLC.

The enhanced data protection mode is used, which, according to information from the provider, only initiates the storage of user information when the video(s) is/are played. If the playback of embedded YouTube videos is started, the provider “YouTube” uses cookies to collect information about user behaviour. According to information from “YouTube”, these are used, among other things, to record video statistics, improve user-friendliness and prevent abusive practices. If you are logged into Google, your data is assigned directly to your account when you click on a video. If you do not wish this association with your profile on YouTube, you must log out before activating the button. Google stores your data (even for users who are not logged in) as user profiles and evaluates them. Such evaluation takes place in particular pursuant to Art. 6(1)(f) GDPR on the basis of Google’s legitimate interests in displaying personalised advertising, market research and/or designing its website in line with demand. You have the right to object to the creation of these user profiles, and you must contact YouTube to exercise this right.

Google LLC, based in the USA, is certified under the US-European data protection framework “Privacy Shield”, which ensures compliance with the level of data protection applicable in the EU. The provision of your data is not mandatory or contractually or legally required for social media purposes. The storage period is determined by the parameters set by Google.

Further information on data protection at “YouTube” can be found in the provider’s privacy policy at: https://www.google.de/intl/de/policies/privacy

- Sharing content via plugins (Facebook, Google+1, Twitter & Co.)

The content on our pages can be shared on social networks such as Facebook, Twitter or Google+ in compliance with data protection laws. For this purpose, this site uses the eRecht24 Safe Sharing Tool. This tool only establishes direct contact between the networks and users once the user actively clicks on one of these buttons.

This tool does not automatically transfer user data to the operators of these platforms. If the user is logged into one of the social networks, when using the social buttons of Facebook, Google+1, Twitter & Co., an information window appears in which the user can confirm the text before sending.

Our users can share the content of this site on social networks in compliance with data protection laws, without complete browsing profiles being created by the network operators.

- Facebook plugins (Like & Share button)

Plugins of the social network Facebook, provider Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA, are integrated on our pages. When you visit our pages, a direct connection is established between your browser and the Facebook server via the plugin. Facebook thereby receives the information that you have visited our site with your IP address. If you click the Facebook “Like button” while logged into your Facebook account, you can link the content of our pages to your Facebook profile. This allows Facebook to assign the visit to our pages to your user account. We would like to point out that, as the provider of the pages, we receive no knowledge of the content of the transmitted data or its use by Facebook. Further information on this can be found in Facebook’s privacy policy at: https://de-de.facebook.com/policy.php.

If you do not wish Facebook to be able to assign the visit to our pages to your Facebook user account, please log out of your Facebook user account.

8. Online Marketing

8.1 Use of Google AdWords Conversion Tracking

This website uses the online advertising programme “Google AdWords” and, within the framework of Google AdWords, the conversion tracking of Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). We use the services offered by Google AdWords to draw attention to our attractive offers on external websites with the help of advertising media (so-called Google AdWords). In relation to the data of the advertising campaigns, we can determine how successful the individual advertising measures are. In doing so, we pursue the interest of displaying advertising to you that is of interest to you, making our website more interesting for you, and achieving a fair calculation of advertising costs.

The cookie for conversion tracking is set when a user clicks on an AdWords advertisement placed by Google. Cookies are small text files that are stored on your computer system. These cookies usually lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognise that the user clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie. Cookies can therefore not be tracked across the websites of AdWords customers. The information obtained with the aid of the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. The customers learn the total number of users who clicked on their ad and were redirected to a page provided with a conversion tracking tag. However, they do not receive any information that can be used to identify users personally. If you do not wish to participate in tracking, you can block this use by deactivating the Google conversion tracking cookie via your Internet browser under user settings. You will then not be included in the conversion tracking statistics. We use Google AdWords on the basis of our legitimate interest in targeted advertising pursuant to Art. 6(1)(f) GDPR. In the course of processing, personal data in the form of, for example, IP addresses or Google profile information is transferred to Google.

Google LLC, with its registered office in the USA, is certified under the US-European “Privacy Shield” data protection framework, which guarantees compliance with the data protection level applicable in the EU. The provision of your data is not mandatory or contractually or legally required for online marketing purposes. The storage period is determined according to the parameters established by Google.

You can find further information on Google’s privacy policy at the following Internet address: http://www.google.de/policies/privacy/

You can permanently deactivate cookies for ad preferences by preventing them through an appropriate setting of your browser software or by downloading and installing the browser plug-in available under the following link: http://www.google.com/settings/ads/plugin?hl=de

Please note that certain functions of this website may not be usable or may only be usable to a limited extent if you have deactivated the use of cookies.

8.2 Use of affiliate-based programmes

- Gewerbegebiete Leads Manager

Within the scope of its tracking services, Leads Manager stores cookies on the terminal devices of users who visit or use websites or other online offerings of its customers in order to document transactions and viewed offers (e.g. leads and sales).

User profiles can be created from this data under a pseudonym. A so-called tracking script is used for this purpose, which serves to collect company-related data. Without the separately granted consent of the data subject, the data collected using this technology will not be used to personally identify the visitor to this website and will not be combined with personal data concerning the bearer of the pseudonym.

Insofar as the information also contains personal data, the processing described is carried out on the basis of our legitimate interest in processing payments with customers pursuant to Art. 6(1)(a) GDPR. The provision of your data is not mandatory or contractually or legally required for the purposes of the affiliate programmes. If you have not used your profile for 12 months, your profile and affiliate logs will be deleted.

If you do not wish cookies to be stored in your browser, you can achieve this through the appropriate browser settings. In your respective browser, you can deactivate the storage of cookies under Tools/Internet Options, restrict it to certain websites, or configure your browser to notify you as soon as a cookie is sent. Please note, however, that in this case you must expect a restricted display of the online offerings and limited user navigation. You can also delete cookies at any time. In this case, the information stored in them will be removed from your terminal device.

9. Web analysis services

9.1 Google (Universal) Analytics

- Google Analytics

This website uses Google Analytics, a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses so-called “cookies”, which are text files stored on your computer that enable an analysis of your use of the website. The information generated by the cookie about your use of this website (including the truncated IP address) is usually transmitted to a Google server in the USA and stored there.

This website uses Google Analytics exclusively with the extension “_anonymizeIp()”, which ensures the anonymisation of the IP address by truncation and excludes direct personal reference. As a result of this extension, your IP address is truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. This processing takes place pursuant to Art. 6(1)(f) GDPR on the basis of our legitimate interest in the statistical analysis of user behaviour for optimisation and marketing purposes.

On our behalf, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide us with further services related to website usage and internet usage. The data transmitted by your browser within the framework of Google Analytics is not combined with other data from Google.

You can prevent the storage of cookies by setting your browser software accordingly; however, we would point out that in this case you may not be able to use all functions of this website to their full extent. Furthermore, you can prevent the collection of the data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available under the following link:http://tools.google.com/dlpage/gaoptout?hl=de

Another way to prevent collection by Google Analytics is to set an opt-out cookie.

Google LLC, based in the USA, is certified under the US-European data protection agreement “Privacy Shield”, which ensures compliance with the level of data protection applicable in the EU. The provision of your data is not mandatory or contractually or legally required for the purposes of statistical analysis. The storage period is determined in accordance with the parameters established by Google. We delete anonymised usage data within 12 months.

More information on the handling of user data by Google Analytics can be found in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de

9.2 SalesViewer

Use of SalesViewer® technology:

On this website, data is collected, stored and transmitted to Salesviewer for marketing, market research and optimisation purposes using the SalesViewer® technology of SalesViewer® GmbH on the basis of legitimate interests of the website operator (Art. 6(1)(f) GDPR).

For this purpose, a JavaScript-based code is used which serves to collect company-related data and for the corresponding use. The data collected using this technology is encrypted via a non-reversible one-way function (so-called hashing). The data is pseudonymised immediately and is not used to personally identify the visitor to this website.

The collection and storage of data may be objected to at any time with effect for the future by clicking this link HERE to prevent collection by SalesViewer® within this website in the future. An opt-out cookie for this website will be stored on your device. If you delete your cookies in this browser, you must click this link again.

The provision of your data is not mandatory or contractually or legally required for statistical analysis purposes. The storage period is determined in accordance with the parameters established by Salesviewer.

9.3 Facebook Pixel

Use of the Facebook Pixel:

Our website uses the visitor action pixel of Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) for conversion measurement.

This allows the behaviour of page visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. This makes it possible to evaluate the effectiveness of Facebook advertisements for statistical and market research purposes and to optimise future advertising measures.

The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Policy. This allows Facebook to enable the placement of advertisements on Facebook pages and outside Facebook. This use of data cannot be influenced by us as the site operator.

The use of Facebook Pixel is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in effective advertising measures including social media.

In Facebook’s privacy notice you will find further information on protecting your privacy: https://de-de.facebook.com/about/privacy/.

You can also deactivate the remarketing feature “Custom Audiences” in the ad settings area at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged into Facebook to do this.

If you do not have a Facebook account, you can deactivate usage-based advertising by Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

10. Tools and Miscellaneous

10.1 Google Maps

On our website, we use Google Maps (API) from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Maps is a web service for displaying interactive (land) maps in order to visually display geographical information. By using this service, our location is displayed to you, the location of properties is displayed and any journey to them is made easier.

As soon as you access those sub-pages into which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers in the USA and stored there. This takes place regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged into Google, your data will be assigned directly to your account. If you do not wish the assignment to your profile with Google, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation takes place in particular pursuant to Art. 6(1)(f) GDPR on the basis of Google’s legitimate interests in the display of personalised advertising, market research and/or the needs-based design of its website. You have a right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.

Google LLC, based in the USA, is certified for the US-European data protection agreement “Privacy Shield”, which ensures compliance with the level of data protection applicable in the EU.

If you do not agree to the future transmission of your data to Google in the context of the use of Google Maps, there is also the option of deactivating the Google Maps web service completely by switching off the JavaScript application in your browser. Google Maps and thus also the map display on this website can then no longer be used.

You can view Google’s Terms of Service at http://www.google.de/intl/de/policies/terms/regional.html; the additional terms of service for Google Maps can be found at https://www.google.com/intl/de_US/help/terms_maps.html

Detailed information on data protection in connection with the use of Google Maps can be found on Google’s website (“Google Privacy Policy”): http://www.google.de/intl/de/policies/privacy/

The provision of your data is not mandatory or contractually or legally required for map display purposes. The storage period is determined in accordance with the parameters established by Google. We do not store any usage data regarding the use of the maps.

10.2 Hotjar

We use Hotjar in order to better understand our users’ needs and to optimise the offering on this website. With the help of Hotjar’s technology, we gain a better understanding of our users’ experiences (e.g. how much time users spend on which pages, which links they click, what they like and do not like, etc.), and this helps us tailor our offering to our users’ feedback.

Hotjar uses cookies and other technologies to collect information about our users’ behaviour and their end devices (in particular, the device’s IP address (captured and stored only in anonymised form), screen size, device type (unique device identifiers), information about the browser used, location (country only), preferred language for displaying our website). 11. Rights of the data subject

11.1 Applicable data protection law grants you comprehensive data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, about which we inform you below:

- Right of access pursuant to Art. 15 GDPR: In particular, you have a right of access to your personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if they were not collected from you by us, the existence of automated decision-making, including profiling, and, where applicable, meaningful information about the logic involved and the significance and envisaged consequences of such processing for you, as well as your right to be informed about the safeguards that exist pursuant to Art. 46 GDPR where your data are transferred to third countries;

- Right to rectification pursuant to Art. 16 GDPR: You have the right to obtain without undue delay the rectification of inaccurate data concerning you and/or the completion of your incomplete data stored by us;

- Right to erasure pursuant to Art. 17 GDPR: You have the right to request the erasure of your personal data where the requirements of Art. 17(1) GDPR are met. However, this right does not exist, in particular, where processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims;

- Right to restriction of processing pursuant to Art. 18 GDPR: You have the right to request the restriction of the processing of your personal data for as long as the accuracy of your data contested by you is being verified; where you refuse the erasure of your data due to unlawful data processing and instead request the restriction of the processing of your data; where you require your data for the establishment, exercise or defence of legal claims after we no longer require these data once the purpose has been achieved; or where you have objected on grounds relating to your particular situation, pending the verification whether our legitimate grounds override yours;

- Right to notification pursuant to Art. 19 GDPR: If you have asserted the right to rectification, erasure or restriction of processing vis-à-vis the controller, the controller is obliged to communicate this rectification or erasure of data or restriction of processing to all recipients to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort. You have the right to be informed about these recipients.

- Right to data portability pursuant to Art. 20 GDPR: You have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request transmission to another controller, where technically feasible;

- Right to withdraw consent granted pursuant to Art. 7(3) GDPR: You have the right to withdraw consent once granted for the processing of data at any time with effect for the future. In the event of withdrawal, we will erase the data concerned without undue delay, provided that further processing cannot be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;

- Right to lodge a complaint pursuant to Art. 77 GDPR: If you consider that the processing of personal data concerning you infringes the GDPR, you have – without prejudice to any other administrative or judicial remedy – the right to lodge a complaint with a supervisory authority (Art. 77 GDPR in conjunction with Section 19 of the Federal Data Protection Act (BDSG)), in particular in the Member State of your habitual residence, your place of work or the place of the alleged infringement. In our case, it is the Bayerisches Landesamt für Datenschutzaufsicht (Bavarian Data Protection Authority).

A list of the supervisory authorities (for the non-public sector) with addresses can be found at: https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html

- Right to object pursuant to Art. 21 GDPR: The data subject has the right to object, on grounds relating to their particular situation, at any time to the processing of personal data concerning them which is based on Article 6(1)(e) or (f); this also applies to profiling based on these provisions.

The controller shall no longer process the personal data unless they can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims.

With regard to the right of access and the right to erasure, the restrictions under Sections 34 and 35 BDSG apply.

11.2 RIGHT TO OBJECT

IF, WITHIN THE SCOPE OF A BALANCING OF INTERESTS, WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME WITH EFFECT FOR THE FUTURE ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO CONTINUE PROCESSING IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU MAY EXERCISE YOUR RIGHT TO OBJECT AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

12. General information on the storage period of personal data

The storage period of personal data is determined by the respective statutory retention period (e.g. commercial and tax law retention periods). After expiry of the period, the corresponding data is routinely erased, provided that it is no longer required for contract fulfilment or contract initiation and/or we no longer have a legitimate interest in continued storage.

16.2 Purposes and legal bases for the processing of personal data in the application procedure

When you apply to us, we collect, process and use your data for the purposes set out below. You decide for yourself which data and information about yourself you wish to provide to us. The provision of personal data is therefore entirely voluntary. By providing this information, you enable us to satisfy your requests for information or to process your application. In the context of the application, the following application data is typically collected and processed:

  • Salutation
  • Title
  • First name
  • Last name
  • Street and house number
  • Postal code and town
  • Email address
  • Telephone/mobile number
  • Cover letter
  • Enclosures to the cover letter and application documents containing details such as: date and place of birth, nationality, marital status, number of children, details of school/training/studies, foreign language skills, IT skills, data on other employment relationships where applicable, social competence, ability to work in a team, reliability, other soft skills where applicable, CV, copies of certificates/references, salary expectations.

During the ongoing candidate selection procedure, you have the opportunity to supplement or update the personal data you have provided to us and to send this to us by email or by post.

We do not require any information from you that cannot be used under the General Act on Equal Treatment (AGG) (e.g. ethnic origin, religion or belief, age, sexual identity). We also ask you not to submit any information regarding pregnancy, political opinions, philosophical or religious beliefs, and trade union membership. The same applies to content that is likely to infringe third-party rights (e.g. copyrights, press law or general third-party rights).

The personal data collected during the candidate selection procedure is required in order to identify you as an applicant, to correspond with you and to make a decision on establishing the employment relationship.

The collection and processing of data is based on a statutory legal basis for the stated purposes and is necessary to conduct the candidate selection procedure. The legal bases are Section 26 of the Federal Data Protection Act (BDSG), Art. 88 GDPR, Art. 6(1) sentence 1(b) GDPR.

Your application will be processed and reviewed exclusively by the relevant contact persons at our company. All employees entrusted with data processing are obliged to maintain the confidentiality of your data. Third parties will not be informed of your details. The processing of data takes place exclusively in Germany.

In the event of rejection or a negative outcome of your application, the transmitted data will be erased no later than 6 months after completion of the application procedure. This does not apply if statutory provisions prevent erasure, or if further storage is required for evidentiary purposes, or if you have consented to longer storage.

If we hire you, the data collected by us during the candidate selection procedure will be stored for the duration of the employment relationship and thereafter for a further 3 years and subsequently erased. Documents relevant to occupational pension schemes will be stored for 30 years. You naturally have the right to withdraw your application at any time.

16.3 Purposes and legal bases for the processing of personal data after unsuccessful completion of the application procedure

If your application should be unsuccessful, we offer to store and process your application data beyond the conclusion of the specific application procedure in order to be able to contact you at a later date if necessary and to continue the application procedure should you be considered for another vacancy. However, such storage and processing will only take place if you expressly give your consent to this.

You can give your consent by attaching a declaration of consent to your application.

Here is a template for the required declaration of consent, which you can send to us signed:

Declaration of consent to the storage of applicant data beyond the completion of the application procedure

Should my application to the companies of the Logivest Group not be successful, I consent to Logivest storing my personal data that I have provided in the course of the entire application procedure (for example in cover letters, CV, certificates/references, applicant questionnaires, applicant interviews, etc.) beyond the end of the specific application procedure. I consent to Logivest using this data to contact me at a later date if necessary and to continue the application procedure should I be considered for another vacancy.

This consent also applies to data concerning my qualifications and activities from generally accessible data sources (in particular professional social networks) that Logivest has lawfully collected in the course of the application procedure. My data will not be passed on to third parties.

This consent is voluntary and has no effect on my chances in the current application procedure. I can refuse it without giving reasons and without having to fear any disadvantages as a result.

I can also withdraw my consent at any time – for example by email to Logivest; in this case, my data will be erased without undue delay after completion of the application procedure or upon receipt of the withdrawal.

Additional declaration regarding special categories of personal data:

My application may contain special categories of personal data (e.g. details of marital status which may include information about my sex life or sexual orientation; details regarding my health; a photograph that allows conclusions to be drawn about my racial or ethnic origin and, where applicable, my eyesight and/or religion, or similarly sensitive data within the meaning of Article 9 of the General Data Protection Regulation). My application in its present form may therefore only be processed with my consent.

I consent to Logivest processing the special categories of personal data contained in my letter of application and the attached documents for the purpose of conducting the application procedure. This consent serves exclusively to enable the application to be considered at all in its present form. The information will not be taken into account in the application process unless there is a legal obligation to do so – in particular in the case of severely disabled persons.

My data will not be passed on to third parties. I am under no obligation to grant this consent and may instead submit an application redacted of the special categories of personal data, without this affecting my chances in the application procedure. I may refuse my consent without giving reasons and may withdraw consent once granted at any time – preferably online via the application system. In the event of withdrawal, my data covered by the consent will be erased immediately. In the event that consent is not granted or is withdrawn, however, my application already submitted cannot be considered in its present form.

In the event that you declare your consent, the legal basis for processing your personal data is Art. 9(2)(a) GDPR.

16.4 Recipients of personal data / no transfer to a third country

Within our company, only those departments or employees who need the user’s data to fulfil our contractual and legal obligations or for the purpose of pursuing our legitimate interests are granted access to them.

A transfer of the user’s personal data to third parties takes place exclusively (a) in the context of contract processing, or (b) for the purposes of fulfilling legal requirements under which we are obliged to provide information, report or pass on data, or (c) where data transfer is in the public interest, or (d) where external service providers process the data on our behalf, or (e) on the basis of our legitimate interest or the legitimate interest of the third party, or (f) where you as user have granted consent to transfer to third parties.

Our website is maintained by service providers acting as our processors.

For our application process, we use HR management software with the help of which we can manage the application process and job postings.

All service providers are contractually obliged to treat your data confidentially.

No transfer of your personal data to a third country takes place.

16.5 Storage period of personal data

We process and store your personal data for the duration of the pre-contractual relationship existing between you and us. Applicant data is erased in accordance with Section 2, unless you grant your consent to applicant data being stored beyond the conclusion of the application procedure in accordance with Section 3.

16.6 Your rights as a data subject

You have the following rights:

Right of access to the relevant personal data (Art. 15 GDPR),

  • Right to rectification (Art. 16 GDPR),
  • Right to erasure (Art. 17 GDPR),
  • Right to restriction of processing (Art. 18 GDPR),

  • Right to lodge a complaint with a supervisory authority (Art. 77 GDPR).

16.7 Your obligation to provide personal data and possible consequences of failure to provide such data

The provision of personal data is required for the evaluation procedure, as otherwise you cannot be considered as an applicant.

16.8 No automated decision-making

We do not carry out automated decision-making within the meaning of Art. 22(1) GDPR which produces legal effects concerning you or similarly significantly affects you.

16.9 Notice on the right to object under Art. 21 GDPR

16.9.1 Right to object on grounds relating to your particular situation

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6(1) sentence 1(e) (public security) or (f) (data processing on the basis of a balancing of interests) GDPR; this also applies to profiling based on these provisions. If you object, we will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

16.9.2 Recipient of the objection

Please address your objection to the address stated in the Legal Notice or to the following email address: [email protected]

16.10 Changes to this privacy policy
